Terms of Service

These Terms of Service ("Terms") govern your use of the ServiceTurbine platform at serviceturbine.com ("Service"), operated by ServiceTurbine ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Description of Service

ServiceTurbine provides a lead capture and business growth platform for home service contractors. The Service includes hosted ServiceTurbine pages, embeddable lead capture widgets, AI-powered lead qualification, lead management tools, notifications via email and SMS, and related features.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By creating an account, you represent that you meet these requirements.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send spam, unsolicited messages, or misleading content through the Service
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with the Service's operation or other users' access
  • Collect or harvest data from the Service without authorization
  • Use the Service to transmit malware or harmful code

5. SMS Notifications

ServiceTurbine offers SMS notifications to alert contractors when new leads are submitted. These messages are transactional only - we do not send marketing or promotional text messages.

By enabling SMS notifications in your account settings and providing your phone number, you expressly agree to receive transactional text messages from ServiceTurbine at the number you provide. Consent to receive SMS is not a condition of using the Service. Message frequency varies based on your lead volume. Message and data rates may apply. Messages are sent from +1 (317) 943-6551.

You may opt out at any time by replying STOP to any message or by disabling SMS notifications in your account under Settings > Alerts. After opting out, you will receive a single confirmation message and no further texts. For assistance, reply HELP to any message or email support@serviceturbine.com.

We will never share your phone number with third parties for marketing purposes. See our Privacy Policy for full details on how we handle your information.

6. Pricing and Payment

ServiceTurbine offers free and paid subscription plans. Paid plans are billed monthly. Prices are listed on our website and may change with 30 days' notice. Payments are processed by Stripe. You authorize us to charge your payment method on a recurring basis until you cancel.

7. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

8. Intellectual Property

The Service, including its design, code, and content, is owned by ServiceTurbine and protected by intellectual property laws. You retain ownership of content you submit through the Service (business information, lead data). You grant us a license to use that content solely to provide the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, ServiceTurbine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless ServiceTurbine from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and changing the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles.
